1. Acceptance of Terms
Welcome to Kissy ("App", "Service"). These Terms of Service, together with our Privacy Policy and End User License Agreement ("EULA"), constitute a legally binding agreement between you and Kissy. By downloading, installing, registering, accessing, or using Kissy, you agree to be bound by these terms. If you do not agree to these terms, do not access or use the App.
2. Eligibility and Account Security
Kissy is intended for personal, non-commercial use by individuals who are at least 17 years old. By registering, you confirm that you meet this age requirement and have the legal capacity to enter into these terms. You are responsible for safeguarding your login credentials (via Apple Sign-in or Email) and for all activities that occur under your account.
3. Private Couple Space & User Content
Kissy lets you create relationship notes, photos, memories, daily answers, and messages in a couple space. Local storage and invitation sharing are described in our Privacy Policy. You keep ownership of your content and grant Kissy a limited, worldwide, non-exclusive license to store, display, process, and transmit it only as needed to provide the features you use.
4. Community Standards & Zero Tolerance for Objectionable Content (EULA)
There is zero tolerance for objectionable, harmful, or abusive content and behavior. In compliance with App Store safety guidelines, you agree NOT to upload, post, transmit, or share any content that:
- Is unlawful, defamatory, libelous, fraudulent, obscene, sexually explicit, or pornographic.
- Depicts sexual violence, non-consensual sexual content, or child sexual exploitation and abuse (CSAM).
- Promotes hate speech, violence, discrimination, or harassment against any individual or protected group.
- Infringes upon the intellectual property, privacy, or publicity rights of any third party.
- Contains malicious code, viruses, automated bots, scrapers, or security circumvention tools.
We reserve the right to review, restrict, filter, or immediately delete any content and terminate or suspend accounts that violate these safety standards without prior notice.
5. Content Moderation & Reporting Mechanisms
To report abusive behavior or objectionable material, email support@kissy.app. Reports are investigated and acted upon within 24 hours. You can delete your account anytime from Profile > Delete account. Account deletion is separate from reporting abuse.
6. Device Permissions and Features
Certain features in Kissy require permissions for camera access, photo library access, location services, or push notifications. Permissions are optional, but denying them may limit the corresponding functionality (such as photo sharing or notification alerts). You may revoke permissions at any time via iOS Settings.
7. Intellectual Property Rights
The Kissy app, software, design, user interface, brand assets, logos, visual graphics, animations, code, and trade dress are the exclusive property of Kissy and its licensors, protected by copyright, trademark, and other applicable intellectual property laws. Nothing in these terms grants you any right to copy, modify, distribute, reverse engineer, or decompile the software.
8. Third-Party Services
Kissy uses third-party services, including Sign in with Apple, Firebase, Adjust, and Meta (Facebook SDK), as described in our Privacy Policy. These services may also be subject to their own terms and policies.
9. Disclaimer of Warranties
Kissy is provided strictly on an "AS IS" and "AS AVAILABLE" basis. To the maximum extent permitted by applicable law, we expressly disclaim all warranties of any kind, whether express, implied, or statutory, including without limitation warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.
10. Limitation of Liability
To the fullest extent permitted by law, Kissy, its developers, affiliates, directors, employees, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of goodwill, device failure, or personal disputes, resulting from your access to or use of (or inability to use) the App.
11. Termination
You may stop using Kissy at any time. To delete your account, use Profile > Delete account. Uninstalling the app alone does not delete your online account. We may suspend or terminate access if you breach these terms or create risk for others.
12. Governing Law & Dispute Resolution
These terms shall be governed by and construed in accordance with the laws of the applicable jurisdiction, without giving effect to any conflict of law principles. Any dispute arising from these terms shall be resolved through good-faith informal consultation or competent courts.
13. Changes to Terms
We may amend these Terms of Service from time to time. We will indicate the update date at the top of this document. Continued use of the App following any update constitutes your agreement to the modified terms.
